Terms and Conditions

1.0 Acceptance of Terms
1.1 These Terms & Conditions incorporate our Privacy Policy and any other applicable policies available on our app or website.
1.2 A legally binding agreement is formed when you place an order or subscribe and accept these Terms.
1.3 By accepting, you confirm you are at least 18 years old and legally capable of entering into a binding contract.
1.4 The service will begin immediately upon confirmation of your subscription or order.
1.5 If you do not agree to these Terms, please do not use our services.
2.0 Definitions & Interpretation
2.1 In these Terms:
- App: Our web application, hosted at www.drinkspass.co.uk
- Company:Drinkspass, operated by el Tab Ltd.
- Customer / You: A person or entity who accesses or subscribes to our Services.
- Services: Access to digital or physical membership benefits, including discounts, promotions, and any associated features.
- Order: A subscription or purchase made via our website.
- Contract: The agreement between you and the Company incorporating these Terms and your Order.
2.2 Interpretations:
- Headings are for convenience and do not affect meaning.
- References to laws include amendments and statutory instruments.
- The singular includes the plural, and vice versa.
3.0 Membership & Orders
3.1 Your membership is continuous unless stated otherwise or terminated in accordance with these Terms.
3.2 Memberships will automatically renew unless cancelled through our online process (see FAQs)..
3.3 Reminders for annual plans will be sent to your registered email.
3.4 If your initial sign-up did not require payment details, your membership will not auto-renew.
3.5 Additional or upgraded memberships will align with your main plan unless specified.
4.0 Billing & Payments
4.1 Payments must be made via an accepted payment method (e.g. card, PayPal)..
4.2 Auto-renewals grant us permission to charge the original payment method unless updated by you.
4.3 Pricing includes applicable VAT.
4.4 We may change our pricing with 14 days' notice; changes take effect on your next billing cycle.
4.5 No refunds or credits are issued for unused periods or early cancellations during a paid term.
4.6 Pro-rata charges may apply for upgrades or changes.
5.0 Right to Cancel
5.1 Under consumer law, you have a 14-day “cooling-off period” to cancel after your initial agreement.
5.2 If you use services during this period, a proportional fee may be retained.
5.3 Cooling-off does not apply to renewals or upgrades.
5.4 Cancellation during trials may result in immediate service termination.
6.0 Use of Service
6.1 You may access digital services via the App immediately after subscription.
6.2 Offers are not combinable with other promotions unless stated.
6.3 Memberships are non-transferable and for individual use only.
6.4 Participating venues may change their terms or withdraw at any time.
6.5 We are not responsible for venue availability or service quality; any disputes are between you and the venue.
7.0 The Service
7.1 Drinkspass operates as a daily, digital, 50% off drinks platform. Members can use the discovery tool to search for venues that are running Drinkspass that day. Members can redeem a maximum of 6 x 50% off drinks per day (see 7.2 for exceptions).
7.2 If a member gets someone else to sign up using their personal referral code, both the referrer and the referee automatically receive an additional 50% off drink, which will instantly be added to their Drinkspass once the referee’s payment has been processed. The additional drink token must be used on the day of issuance, otherwise it will expire.
7.3 To redeem, members show their Drinkspass at the bar, and the bar staff will double tap the relevant section of the app. The member must then immediately pay their bill, to which a 50% discount will be applied.
7.4 Members can use their Drinkspass across multiple venues each day.
7.5 Drinkpass can be used for the duration that a partner venue is open, and there are no restrictions to the drinks that can be redeemed (see 7.5 for exceptions).
7.6 In exceptional circumstances venues may impose restrictions on redeemable drinks or the time in which Drinkspass can be used. Restrictions will be made clear on our website.
7.7 Drinkspass venues vary daily and are listed on the Drinkspass website.
7.8 Drinkspass members must abide by the ‘HOUSE RULES’. There are 5 House Rules:
- 1 drink = 1 token
- Max 2 drinks per order
- +1 token for each time referral code is used
- Drinkspass must be double tapped by bar staff to redeem
- Not to be used in conjunction with venue deals
8.0 Membership
8.1 There are two membership options: The monthly (£9.99/month) and the annual (£59.99/year).
8.2 Both membership options auto-renew unless cancelled.
8.3 Members can cancel at any time via our website.
8.4 Members are prohibited from having two or more concurrent memberships.
8.5 If a member gets 5 people to join the app using their personal referral code they will automatically receive 6 free months on the app, commencing from their next renewal date.
9.0 Suspension & Termination
9.1 We may suspend services if:
- Payments are missed,
- Credit limits are exceeded,
- We identify misuse or breach of terms,
- There is suspicion of fraud or unauthorised activity.
9.2 We may immediately terminate subscriptions without cause.
10.0 Liability
10.1 Our liability is limited to:
- Reperformance of services, or
- Refund of the amount paid for the affected service (at our discretion).
10.2 We are not liable for:
- Venue performance or fulfillment of offers,
- Indirect or consequential damages,
- Loss of profits or goodwill.
10.3 Nothing limits liability for death, personal injury due to negligence, or fraud.
11.0 Confidentiality & Data
11.1 We maintain strict confidentiality and security standards.
11.2 You consent to our collection and use of your personal data per our Privacy Policy.
11.3 We will not share your data without consent unless required by law.
12.0 Intellectual Property
12.1 All intellectual property (IP) remains the sole property of the Company.
12.2 You must not copy, distribute, or exploit our content without permission.
13.0 Disputes
13.1 Both parties agree to attempt to resolve disputes amicably before seeking legal action.
13.2 Nothing prevents either party from seeking court intervention for urgent matters.
14.0 Notices
14.1 Notices must be delivered to the email or postal address on file.
14.2 Notices sent by email are deemed received upon sending.
14.3 Postal notices are deemed received three business days after dispatch.
15.0 General Terms
15.1 This contract is the entire agreement and supersedes prior understandings.
15.2 No waiver of rights is effective unless in writing.
15.3 If any clause is found unenforceable, the rest remain valid.
15.4 You may not assign this agreement without our written consent.
15.5 We may amend these Terms with notice; continued use indicates acceptance.
15.6 Nothing in this contract creates a partnership or agency.
15.7 These Terms are governed by UK law and subject to the jurisdiction of UK courts.
